CONDITIONS GÉNÉRALES DE VENTE - ELIJOOH-ECOCLEAN

1. Objet et Primauté

Les présentes conditions générales de vente (CGV) régissent l'ensemble des relations contractuelles entre Elijooh-ecoclean et ses clients. Elles sont systématiquement communiquées lors de chaque offre ou commande. En passant commande, le client reconnaît en avoir pris connaissance et les accepter sans réserve. Le client renonce expressément à ses propres conditions générales d'achat. Toute dérogation doit être convenue par écrit.

2. Paiement et Délais

Nos factures sont payables dans un délai de 21 jours ouvrables à compter de la date d'émission, par virement bancaire sur le compte mentionné sur la facture. Les paiements doivent être effectués pour le montant total facturé, sans aucune déduction, escompte ou compensation de la part du client, sauf accord écrit préalable.

3. Retards de paiement et Pénalités

En cas de non-paiement à l'échéance :

Point de départ : Les intérêts et pénalités courent de plein droit dès le lendemain de la date d'échéance.
Intérêts : Un intérêt forfaitaire de 10 % l'an est dû.
Indemnité forfaitaire (Clause pénale) : Une indemnité de 10 % du montant impayé (min. 40 €) est exigible de plein droit.
Frais de rappel : Des frais administratifs de 15 € sont facturés à chaque rappel envoyé, dès le premier rappel.
Suspension des services : Elijooh-ecoclean se réserve le droit de suspendre ses prestations en cas d'impayé, après un préavis de 48 heures envoyé par écrit (e-mail ou courrier), et ce jusqu'au complet paiement.

4. Recouvrement

Après soixante (60) jours d'impayé, et après une mise en demeure notifiant l'intention de recouvrement forcé, le dossier pourra être transmis à un huissier ou une société de recouvrement. Les frais de procédure, honoraires et dépens seront intégralement à la charge du client.

5. Fiscalité Internationale

Toute retenue à la source imposée par la législation du pays du client est à la charge exclusive de ce dernier. Elijooh-ecoclean doit percevoir le montant net intégral de la facture initiale. Le client est responsable de sa conformité avec ses obligations fiscales locales.

6. Responsabilité et Obligation de Moyens

Elijooh-ecoclean s'engage à une obligation de moyens selon les règles de l'art. Notre responsabilité est limitée au montant de la prestation facturée, sauf en cas de dol ou de faute lourde. Nous ne pourrons être appelés en garantie par le client pour des dommages réclamés par des tiers.

7. Réclamations

Toute réclamation doit être notifiée par lettre recommandée au siège social d'Elijooh-ecoclean dans les 15 jours suivant la prestation. Elle doit détailler précisément les griefs. Elijooh-ecoclean s'engage à fournir une réponse écrite dans les 15 jours ouvrables. À défaut de réponse dans ce délai, le client est invité à relancer la direction pour une résolution amiable avant toute autre démarche.

8. Droit applicable et Compétence territoriale

Le droit belge est exclusivement applicable. En cas de litige, seuls les tribunaux de l'arrondissement judiciaire de La Louvière (Hainaut - Division Mons) sont compétents.

ALGEMENE VERKOOPVOORWAARDEN - ELIJOOH-ECOCLEAN

1. Voorwerp en Voorrang Deze algemene verkoopvoorwaarden (AVV) regelen alle contractuele relaties tussen Elijooh-ecoclean en haar klanten. Ze worden systematisch gecommuniceerd bij elke offerte of bestelling. Door een bestelling te plaatsen, erkent de klant hiervan kennis te hebben genomen en deze zonder voorbehoud te aanvaarden. De klant doet uitdrukkelijk afstand van zijn eigen algemene aankoopvoorwaarden. Elke afwijking moet schriftelijk worden overeengekomen.

2. Betaling en Termijnen Onze facturen zijn betaalbaar binnen een termijn van 21 werkdagen na factuurdatum, via bankoverschrijving op het rekeningnummer vermeld op de factuur. Betalingen moeten worden uitgevoerd voor het volledige gefactureerde bedrag, zonder enige aftrek, korting of schuldvergelijking door de klant, tenzij voorafgaandelijk schriftelijk akkoord.

3. Betalingsachterstand en Sancties Bij niet-betaling op de vervaldag:

Ingangsdatum: Intresten en schadevergoedingen zijn van rechtswege verschuldigd vanaf de dag volgend op de vervaldag, zonder voorafgaande ingebrekestelling.
Intresten: Een forfaitaire intrest van 10% per jaar is verschuldigd.
Forfaitaire vergoeding (Strafbeding): Een vergoeding van 10% van het onbetaalde bedrag (min. €40) is van rechtswege opeisbaar.
Aanmaningskosten: Administratieve kosten van €15 worden per verzonden aanmaning aangerekend, vanaf de eerste aanmaning.
Opschorting van diensten: Elijooh-ecoclean behoudt zich het recht voor om haar diensten op te schorten bij wanbetaling, mits een opzegtermijn van 48 uur via schriftelijke weg (e-mail of post), en dit tot volledige betaling.

4. Invordering Na zestig (60) dagen wanbetaling, en na een ingebrekestelling waarin het voornemen tot gedwongen invordering wordt meegedeeld, kan het dossier worden overgedragen aan een gerechtsdeurwaarder of incassobureau. Procedurekosten, erelonen en onkosten vallen integraal ten laste van de klant.

5. Internationale Fiscaliteit Elke bronheffing opgelegd door de wetgeving van het land van de klant valt uitsluitend ten laste van de klant. Elijooh-ecoclean moet het volledige nettobedrag van de oorspronkelijke factuur ontvangen.

6. Aansprakelijkheid en Middelenverbintenis Elijooh-ecoclean verbindt zich tot een middelenverbintenis volgens de regels van de kunst. Onze aansprakelijkheid is beperkt tot het bedrag van de gefactureerde prestatie, behalve in geval van bedrog of zware fout.

7. Klachten Elke klacht moet per aangetekend schrijven worden gemeld aan de maatschappelijke zetel van Elijooh-ecoclean binnen 15 dagen na de prestatie. Elijooh-ecoclean verbindt zich ertoe binnen 15 werkdagen schriftelijk te antwoorden.

8. Toepasselijk recht en Bevoegde rechtbank Het Belgisch recht is exclusief van toepassing. In geval van betwisting zijn enkel de rechtbanken van het gerechtelijk arrondissement La Louvière (Henegouwen - Afdeling Bergen) bevoegd.

GENERAL TERMS AND CONDITIONS OF SALE - ELIJOOH-ECOCLEAN

1. Purpose and Precedence These General Terms and Conditions of Sale (GTC) govern all contractual relations between Elijooh-ecoclean and its clients. They are systematically provided with every quote or order. By placing an order, the client acknowledges having read and accepted them without reservation. The client expressly waives their own general terms and conditions of purchase. Any derogation must be agreed upon in writing.

2. Payment and Deadlines Our invoices are payable within 21 working days of the invoice date, by bank transfer to the account mentioned on the invoice. Payments must be made for the full invoiced amount, without any deduction, discount, or set-off by the client, unless previously agreed in writing.

3. Late Payment and Penalties In the event of non-payment by the due date:

Start date: Interest and penalties shall accrue automatically and without prior notice from the day following the due date.
Interest: Fixed interest of 10% per annum shall be due.
Fixed Indemnity (Penalty Clause): An indemnity of 10% of the outstanding amount (min. €40) is legally due.
Reminder Fees: Administrative fees of €15 will be charged for each reminder sent, starting from the first reminder.
Suspension of Services: Elijooh-ecoclean reserves the right to suspend its services in the event of non-payment, following 48 hours' notice sent in writing (email or mail), until full payment is received.

4. Debt Recovery After sixty (60) days of non-payment, and following a formal notice of intent to proceed with forced recovery, the file may be transferred to a bailiff or a debt collection agency. All procedural costs, legal fees, and expenses shall be borne entirely by the client.

5. International Taxation Any withholding tax imposed by the legislation of the client's country is the sole responsibility of the client. Elijooh-ecoclean must receive the full net amount of the original invoice.

6. Liability and Duty of Care Elijooh-ecoclean commits to a duty of care (obligation of means) in accordance with professional standards. Our liability is limited to the amount of the invoiced service, except in cases of fraud or gross negligence.

7. Claims Any claim must be notified by registered mail to the registered office of Elijooh-ecoclean within 15 days following the service. Elijooh-ecoclean undertakes to provide a written response within 15 working days.

8. Applicable Law and Jurisdiction Belgian law shall exclusively apply. In the event of a dispute, only the courts of the judicial district of La Louvière (Hainaut - Mons Division) shall have jurisdiction.

contractuelles entre Elijooh Institut de Beauté et ses clients. Elles sont communiquées à
chaque client avant ou lors de la première prestation, et affichées en institut. En acceptant un
soin, le client reconnaît en avoir pris connaissance et les accepte sans réserve.
Toute dérogation doit être convenue par écrit.
Ces CGV prévalent sur tout autre document émanant du client, sauf accord écrit explicite de
l'institut.

2. Tarifs et Paiement

Les tarifs en vigueur sont affichés en institut et communiqués sur simple demande. Les prix
sont exprimés en euros et TVA comprise.
Modifications tarifaires : Elijooh Institut de Beauté se réserve le droit de modifier ses tarifs à
tout moment. Les clients seront informés des changements par affichage en institut au moins
15 jours avant leur application. Les tarifs peuvent être ajustés lors d'offres promotionnelles
temporaires, clairement identifiées comme telles.
Le paiement s'effectue immédiatement après la prestation, par :
- Carte bancaire
- Espèces
- Virement préalable (pour les forfaits uniquement)
Aucun escompte ne sera accordé pour paiement comptant.

3. Annulation et Report de Rendez-vous

Modalités d'annulation : le client peut annuler ou reporter son rendez-vous par téléphone, par
email, ou par écrit (SMS/WhatsApp acceptés si confirmés par l'institut).

Les frais d'annulation tardive seront facturés et doivent être réglés avant tout nouveau

4. Contre-indications et Questionnaire Santé

Pour votre sécurité, le client est tenu de déclarer :
- Toute allergie, sensibilité cutanée ou pathologie dermatologique
- Toute grossesse ou allaitement
- Tout traitement médical en cours (Roaccutane, anticoagulants, etc.)
Le client s'engage à remplir un questionnaire de santé à chaque visite ou à signaler tout
changement dans son état de santé depuis la dernière visite.
L'institut se réserve le droit de refuser un soin si une contre-indication est
identifiée, sans que cela puisse donner lieu à indemnisation.

5. Responsabilité et Obligation de Moyens

Elijooh Institut de Beauté s'engage à une obligation de moyens selon les règles de l'art en
matière d'esthétique. Cela signifie que nous mettons en oeuvre tous les moyens
professionnels et techniques appropriés pour réaliser le soin demandé, sans garantir un
résultat spécifique (notamment en raison de la variabilité des réactions individuelles).
Notre responsabilité est limitée au montant de la prestation facturée, sauf en cas de dol ou
faute lourde.
En cas de non-satisfaction avérée et justifiée, le client pourra bénéficier d'une refonte gratuite
du soin dans les 7 jours, ou d'un avoir valable 6 mois, selon la nature du grief.

6. Réclamations

Toute réclamation doit être notifiée :
- Verbalement en institut, ou
- Par écrit (e-mail, courrier, ou formulaire disponible en institut)
Délai : dans les 7 jours suivant la prestation, avec précision des griefs.
Le client doit être en mesure de fournir des preuves de ses griefs si nécessaire (photos,
certificat médical, etc.).
L'institut s'engage à fournir une réponse écrite dans les 7 jours ouvrables.

7. Photos et Confidentialité

Toute photographie avant/après nécessite un consentement écrit préalable du client,
précisant :
- La durée de conservation des images (maximum 2 ans sauf renouvellement)
- L'utilisation prévue : dossier interne, publicité, réseaux sociaux, site web, etc.
Le consentement est matérialisé par un formulaire signé daté, conservé par l'institut pendant
la durée de conservation des images plus 1 an.
Les données personnelles sont traitées conformément au RGPD. Le client dispose d'un droit
d'accès, de rectification et d'effacement.

8. Forfaits et Cartes Cadeaux

Modalités de prorogation : demande écrite (email ou courrier) avant expiration, justifiant d'un
motif légitime (maladie, empêchement majeur). Prorogation maximale : 3 mois. Frais de
prorogation : 10€ pour les cartes cadeaux de plus de 100€.

9. Révisions des CGV

Elijooh Institut de Beauté se réserve le droit de modifier les présentes CGV à tout moment.
Les clients seront informés des modifications par affichage en institut et sur le site web. Les
CGV applicables sont celles en vigueur à la date de la prestation.
Les versions antérieures des CGV sont consultables sur demande écrite auprès de l'institut ou
téléchargeables sur notre site web dans la section 'Mentions légales'.

10. Droit applicable et Compétence territoriale

Le droit belge est exclusivement applicable. En cas de litige, seuls les tribunaux de

Le client est informé qu'il peut également avoir recours à la médiation ou à tout autre mode

1. Doel en Voorrang

Deze algemene verkoopvoorwaarden (AVV) regelen alle contractuele relaties tussen Elijooh Instituut voor Schoonheid en haar klanten. Ze worden aan elke klant meegedeeld vóór of tijdens de eerste behandeling en hangen uit in het instituut. Door het aanvaarden van een behandeling erkent de klant kennis te hebben genomen van deze voorwaarden en aanvaardt hij ze zonder voorbehoud.

Elke afwijking moet schriftelijk worden overeengekomen.

Deze AVV zijn van toepassing boven elk ander document van de klant, tenzij uitdrukkelijk anders schriftelijk overeengekomen met het instituut.

2. Tarieven en Betaling

De geldende tarieven hangen uit in het instituut en worden op eenvoudig verzoek meegedeeld. De prijzen zijn uitgedrukt in euro en inclusief btw.

Wijziging van tarieven: Elijooh Instituut voor Schoonheid behoudt zich het recht voor om haar tarieven op elk moment te wijzigen. Klanten worden op de hoogte gebracht van de wijzigingen door middel van een aankondiging in het instituut, minstens 15 dagen vóór de toepassing ervan. De tarieven kunnen worden aangepast tijdens tijdelijke promotieaanbiedingen, die duidelijk als zodanig worden vermeld.

De betaling gebeurt onmiddellijk na de behandeling, via:

Contant geld
Voorafgaande overschrijving (enkel voor pakketten)
Er wordt geen korting toegestaan voor contante betalingen.

3. Annulering en Uitstel van Afspraken

Annuleringsmodaliteiten: de klant kan zijn afspraak annuleren of uitstellen per telefoon, per e-mail of schriftelijk (SMS/WhatsApp aanvaard indien bevestigd door het instituut).

4. Contra-indicaties en Gezondheidsvragenlijst

Voor uw veiligheid is de klant verplicht om te melden:

Allergieën, huidgevoeligheid of dermatologische aandoeningen
Zwangerschap of borstvoeding
Een lopende medische behandeling (Roaccutane, anticoagulantia, enz.)
De klant verbindt zich ertoe om bij elk bezoek een gezondheidsvragenlijst in te vullen of om elke wijziging in zijn gezondheidstoestand sinds het laatste bezoek te melden.
Het instituut behoudt zich het recht voor om een behandeling te weigeren indien een contra-indicatie wordt vastgesteld, zonder dat dit aanleiding kan geven tot een schadevergoeding.

5. Aansprakelijkheid en Middelenverbintenis

Elijooh Instituut voor Schoonheid verbindt zich tot een middelenverbintenis volgens de regels van de kunst inzake schoonheidsverzorging. Dit betekent dat wij alle passende professionele en technische middelen inzetten om de gevraagde behandeling uit te voeren, zonder een specifiek resultaat te garanderen (onder meer vanwege de variabiliteit van individuele reacties).

Onze aansprakelijkheid is beperkt tot het bedrag van de gefactureerde prestatie, behalve in geval van bedrog of zware fout.

Bij bewezen en gerechtvaardigde ontevredenheid kan de klant binnen 7 dagen een gratis herbewerking van de behandeling krijgen, of een tegoedbon geldig voor 6 maanden, naargelang de aard van de klacht.

6. Klachten

Elke klacht moet worden gemeld:

Mondeling in het instituut, of
Schriftelijk (e-mail, brief of via een formulier dat in het instituut beschikbaar is)
Termijn: binnen 7 dagen na de behandeling, met precisering van de grieven.
De klant moet in staat zijn om zo nodig bewijzen van zijn grieven te leveren (foto's, medisch attest, enz.).
Het instituut verbindt zich ertoe om binnen 7 werkdagen een schriftelijk antwoord te geven.

7. Foto's en Vertrouwelijkheid

Elke voor-/na-foto vereist voorafgaande schriftelijke toestemming van de klant, waarin wordt gepreciseerd:

De bewaartermijn van de beelden (maximum 2 jaar, tenzij verlengd)
Het beoogde gebruik: intern dossier, reclame, sociale media, website, enz.
De toestemming wordt geformaliseerd via een ondertekend en gedateerd formulier, dat door het instituut wordt bewaard gedurende de bewaartermijn van de beelden plus 1 jaar.
Persoonsgegevens worden verwerkt in overeenstemming met de AVG. De klant heeft recht op inzage, verbetering en verwijdering.

8. Pakketten en Cadeaubonnen

Verlengingsmodaliteiten: schriftelijk verzoek (e-mail of brief) vóór vervaldatum, met rechtvaardiging van een legitieme reden (ziekte, ernstige verhindering). Maximale verlenging: 3 maanden. Verlengingskosten: €10 voor cadeaubonnen van meer dan €100.

9. Herziening van de AVV

Elijooh Instituut voor Schoonheid behoudt zich het recht voor om deze AVV op elk moment te wijzigen. Klanten worden op de hoogte gebracht van de wijzigingen via aankondiging in het instituut en op de website. De AVV die van toepassing zijn, zijn deze die gelden op de datum van de behandeling.

Eerdere versies van de AVV zijn op schriftelijk verzoek bij het instituut raadpleegbaar of kunnen worden gedownload op onze website in de rubriek 'Juridische vermeldingen'.

10. Toepasselijk recht en Territoriale bevoegdheid

Het Belgische recht is uitsluitend van toepassing. In geval van een geschil zijn enkel de rechtbanken van het gerechtelijk arrondissement La Louvière (Henegouwen - Afdeling Bergen) bevoegd.

De klant wordt erop gewezen dat hij ook een beroep kan doen op bemiddeling of op elke andere alternatieve methode voor geschillenbeslechting alvorens een gerechtelijke procedure aan te spannen. Het instituut verbindt zich ertoe om in te gaan op elk verzoek tot bemiddeling binnen een redelijke termijn.

By accepting a treatment, the client acknowledges having read them and accepts them without reservation.

Any derogation must be agreed in writing.

These GTC shall prevail over any other document originating from the client, unless explicitly agreed otherwise in writing by the institute.

2. Prices and Payment

Current prices are displayed in the institute and communicated upon simple request. Prices are expressed in euros and include VAT.

Price changes: Elijooh Beauty Institute reserves the right to modify its prices at any time. Clients will be informed of changes by display in the institute at least 15 days before their application. Prices may be adjusted during temporary promotional offers, clearly identified as such.

Payment must be made immediately after the treatment, by:

Bank card
Cash
Prior bank transfer (for packages only)
No discount will be given for cash payments.

3. Cancellation and Rescheduling of Appointments

Cancellation terms: the client may cancel or reschedule their appointment by phone, by email, or in writing (SMS/WhatsApp accepted if confirmed by the institute).

Late cancellation fees will be invoiced and must be paid before any new appointment.

4. Contraindications and Health Questionnaire

For your safety, the client is required to declare:

Any allergies, skin sensitivities or dermatological conditions
Any pregnancy or breastfeeding
Any ongoing medical treatment (Roaccutane, anticoagulants, etc.)
The client undertakes to complete a health questionnaire at each visit or to report any change in their health status since the last visit.
The institute reserves the right to refuse a treatment if a contraindication is identified, without this giving rise to any compensation.

5. Liability and Obligation of Means

Elijooh Beauty Institute undertakes an obligation of means in accordance with professional standards in the field of aesthetics. This means that we deploy all appropriate professional and technical means to carry out the requested treatment, without guaranteeing a specific result (notably due to the variability of individual reactions).

Our liability is limited to the amount of the treatment invoiced, except in cases of fraud or gross negligence.

In the event of proven and justified dissatisfaction, the client may benefit from a free re-treatment within 7 days, or a credit note valid for 6 months, depending on the nature of the grievance.

6. Complaints

Any complaint must be notified:

Verbally at the institute, or
In writing (email, letter, or form available at the institute)
Deadline: within 7 days following the treatment, with a detailed description of the grievances.
The client must be able to provide evidence of their grievances if necessary (photos, medical certificate, etc.).
The institute undertakes to provide a written response within 7 working days.

7. Photos and Confidentiality

Any before/after photograph requires prior written consent from the client, specifying:

The retention period for the images (maximum 2 years unless renewed)
The intended use: internal file, advertising, social media, website, etc.
Consent is formalised by a signed and dated form, kept by the institute for the duration of the image retention period plus 1 year.
Personal data is processed in accordance with the GDPR. The client has the right to access, rectify and delete their data.

8. Packages and Gift Vouchers

Loss/theft	The voucher will not be replaced or refunded. Keep it safe.

Extension terms: written request (email or letter) before expiry, justifying a legitimate reason (illness, major impediment). Maximum extension: 3 months. Extension fee: €10 for gift vouchers over €100.

9. Revision of the GTC

Elijooh Beauty Institute reserves the right to modify these GTC at any time. Clients will be informed of changes by display in the institute and on the website. The GTC applicable are those in force on the date of the treatment.

Previous versions of the GTC are available upon written request to the institute or can be downloaded from our website in the 'Legal notices' section.

10. Applicable Law and Territorial Jurisdiction

Belgian law is exclusively applicable. In the event of a dispute, only the courts of the judicial district of La Louvière (Hainaut - Division Mons) have jurisdiction.

The client is informed that they may also have recourse to mediation or any other alternative dispute resolution method before any legal action. The institute undertakes to respond favourably to any mediation request within a reasonable time.
